,, <br />Introduction <br />Purpose and Scope of this Document. The Colorado Division of Minera's and Geology (the <br />Division) has received an application from RAG Empire Corporation (REC) to renew permit <br />C-81-044 for conducting surface coal mining and reclamation operations at the Eagle No. 5 and 9 <br />Mines (Eagle Mines). REC was formerly known as Cyprus Empire Corporation. The renewal <br />application number is RN-03. Prior to deciding whether or not to approve a renewal application, <br />the Division is required by law to make specific written findings. The two laws which require <br />those tndings are Section 34-33-114 of the Colorado Surface Coal Mining Reclamation Act and <br />Rule 2.07.6(2) of the Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining. This document presents those findings and the Division's proposed decision regarding <br />approval of REC's permit renewal application. The findings and proposed decision can be found <br />at the end of this a document following a summary of the history of perntit C-81-044, a <br />description of the environment affected by the operation, and summaries of the mining and <br />reclamation plans. <br />Replacement of Previous Findings Documen[s. This findings document replaces the findings <br />documents from REC's previous renewals. <br />Information Sources for Permit and Review Process. The review process for permit revisions <br />and renewals is described in the Colorado Surface Coal Mining Reclamation Act (C.R.S. 34-33- <br />101 et seq.) and [he Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining. "Rules" referred to in this document are contained within those regulations.
