with the post-mining land use (4.06.2(1)). Large shrubs and woody plant species <br />will be removed prior to topsoil salvage. Generally, no effort will be made to <br />remove grasses, fortis, and smaller shrubs and woody plants prior to recovery. The <br />Division has approved incorporation of this vegetative material into the topsoil <br />because it helps provide mulch material within the replaced topsoil and provides a <br />source of indigenous plant propagules to aid in establishment of initial vegetative <br />culture on reclaimed areas. <br />B. The Division has determined selected overburden materials shall be used for, or as <br />a supplement to, topsoil. This vaziance applies to areas at t:he SA Portal, old shop, <br />and temporary office area due to their disturbance prior to the Act and the lack of <br />salvaged topsoil at these locations. This determination is based on physical and <br />chemical analyses and field-site trials approved by the Division. Previously, <br />Stipulation No. 2 had been attached to the permit. This stipulation was complied <br />with upon the submission of Technical Revision No. 8. Details of the overburden <br />analysis may be found in Exhibit 4l (4.06.2(4)(a)). <br />IV. Sealing of Drilled Holes and Underground Openings <br />A detailed description of the sealing of underground openings may be found in Section <br />2.05.4 of the permit with a typical portal seal illustrated in Figure 57. Drill hole sealing <br />may be found on in Section 2.05 of the permit. All existing and future drill holes are <br />planned to be sealed in accordance with Rule 4.07. <br />V. Use of Explosives <br />RAG Empire Corporation is not proposing to conduct surface blasting in their mining <br />operation. Should RAG Empire need to conduct surface blastin; in [he mining <br />operation, the requirements of this section must be addressed and submitted to the <br />Division for approval. <br />VI. Coal Mine Waste Banks <br />The applicant has presented a detailed engineering design for an approximately one- <br />million-cubic-yard coal processing waste pile located within the boundaries of the Eagle <br />Mine Complex permit area, as depicted on Permit Map 25. Exhibit 21 of the permit <br />contains a design report for the coal processing waste pile prepared by CTL/Thompson, <br />Inc., and three supplemental documents pertaining to amendments in design details and <br />construction specifications, as well as results of inspection certifications performed by <br />the design engineer. Collectively, these documents represent the amended design for the <br />coal processing waste pile at the Eagle Mine Complex. <br />The applicant will dispose of an additional 200,000 cubic yazds of waste in the <br />abandoned Eagle No. 9 Mine's Portal Excavation, depicted on Permit Map 25. The <br />details of this disposal plan are presented on Map 28 of the amended permit application, <br />including a detailed site plan and appropriate cross sections. <br />27 <br />
