Legal, Financial and Compliance Information - Rule 2.03 <br />She legal, financial and compliance information sections of the permit application <br />for the Bear No. 1 and No. 2 mines can be found on pages 8a-23 of the Bear No. 1 <br />and No. 2 application. Information for the Bear No. 3 application can be found in <br />Section 2.03 of that application. <br />Information requested in the Preliminary Adequacy Review letters (P.A.R.) of <br />May I5, 1981 and January 18, 1982, was submitted by the applicant, thus allowing <br />the Division to make the following written findings. <br />Pursuant to Rule 2.07.6(2)(9), and on the basis of evidence submitted by the applicant, <br />the Division finds that Bear Coal Company does not own or control any operations <br />which are currently in violation of any Iaw, rule, or regulation, or any provision <br />of the Surface Mining Control and Reclamation Act or the Colorado Surface Coal <br />Mining Reclamation Act. <br />Pursuant to Rule 2.07.6(2)(h), the Division finds that Bear Coal Company does not own <br />or control and has not controlled mining operations with a demonstrated pattern of <br />willful violations of the Act of such nature, duration, and with such resulting <br />irreparable damage to the environment as to indicate an intent not to comply with <br />the provisions of the Act. <br />For this operation, private mineral estate has not been severed from private surface <br />estate. The operation does not involve surface coal mining activities. Therefore, <br />the documentation specified by Rule 2.03.6(2) is not required (see Rule 2.07.6(2)(9)). <br />Coal to be mined during the permit term is in Federal Lease No. D-052501, leased to <br />Anchor Coal Company and subleased to Bear Coal Company. Atlantic Richfield (ARCO) <br />and U.S. Steel are the owners of areas affected by the surface facilities of the <br />Bear No. 1 and No. 2 mines. ARCO and Anchor Coal Companies are the owners of the area <br />affected by the proposed surface facilities of the Bear No-3 mine- <br />
