-11-
I. Legal, Financial and Compliance Information - Rule 2.03
She legal, financial and compliance information sections of the permit application
for the Bear No. 1 and No. 2 mines can be found on pages 8a-23 of the Bear No. 1
and No. 2 application. Information for the Bear No. 3 application can be found in
Section 2.03 of that application.
Information requested in the Preliminary Adequacy Review letters (P.A.R.) of
May I5, 1981 and January 18, 1982, was submitted by the applicant, thus allowing
the Division to make the following written findings.
Pursuant to Rule 2.07.6(2)(9), and on the basis of evidence submitted by the applicant,
the Division finds that Bear Coal Company does not own or control any operations
which are currently in violation of any Iaw, rule, or regulation, or any provision
of the Surface Mining Control and Reclamation Act or the Colorado Surface Coal
Mining Reclamation Act.
Pursuant to Rule 2.07.6(2)(h), the Division finds that Bear Coal Company does not own
or control and has not controlled mining operations with a demonstrated pattern of
willful violations of the Act of such nature, duration, and with such resulting
irreparable damage to the environment as to indicate an intent not to comply with
the provisions of the Act.
For this operation, private mineral estate has not been severed from private surface
estate. The operation does not involve surface coal mining activities. Therefore,
the documentation specified by Rule 2.03.6(2) is not required (see Rule 2.07.6(2)(9)).
Coal to be mined during the permit term is in Federal Lease No. D-052501, leased to
Anchor Coal Company and subleased to Bear Coal Company. Atlantic Richfield (ARCO)
and U.S. Steel are the owners of areas affected by the surface facilities of the
Bear No. 1 and No. 2 mines. ARCO and Anchor Coal Companies are the owners of the area
affected by the proposed surface facilities of the Bear No-3 mine-
