Tom, per your request I conducted an AVS check for the Apex Mine (C-81-011}. The system
recommendation is Issue. Please see attached AVS recommendation for further detail.
I have a number of questions that need to be addressed by the operator;
I. The operator provided the Division with names of the owners and controllers of Sunland
Mining Corp., Costain America, Inc., Costain Mining Services, Inc., Costain USA Inc.
and Costain Group PLC. However, the operator did not provide titles for any of the
individuals associated with the above-mentioned companies. Please has the operator
provide titles for all of the individuals listed in the permit.
The AVS and page 4B of the permit list Costain Coal Inc. as an owner of Sunland Mining
Corp. (start date of 5/23/77). The operator did not include a list of the officers and
directors of Costain Coal Inc. in the revised permit pages. Rule 2.03.4(4) requires the
pet7nittee to list the owners and controllers of any company that owns or controls the
applicant. The operator should provide names, positions, and date position was assumed
for Costain Coal Inc. in the permit. If Costain Coal Inc. is no longer an owner of
Sunland, then the Division needs documentation of this termination.
3. Costain Mining Services, Inc. is listed on page 4c of the permit. It is unclear as to how
this company is related to Sunland Mining Corp., or any of the other companies noted in
the permit. Please have the operator describe the relationship of Costain Mining
Services, Inc. to the permittee in the permit.pages.
