• -z- i <br /> <br /> <br />PROPOSED DECISION <br />Salt Creek ?fining Company <br />McClane Canyon ?line <br />The Colorado ?lined Land Reclamation Division propose_ to approve with <br />stipulations an application for a permit to conduct coal mining submitted <br />by Salt Creek Mining Company for the ?icClane Canyon Mine. <br />This approval decision is based on a finding that the proposed operation <br />will comply with all requirements of the Colorado Surface Coal *fining <br />Reclamation Act, C.R.S. 1973, as amended, 34-33-101 et ~., and the <br />Regulations promulgated pursuant to the Act. <br />The permit application and the stipulations ,pill become a binding part of <br />the permit upon approval. The stipulations for the McClane Canyon ?line <br />are as follows: <br />1. IF, DURING THE COURSE OF OPERATIONS, PREVIOUSLY UN'IDEhTTIFIED CULTURAL <br />RESOURCES ARE DISCOVERED, THE APPLICA',TT SHALL INSURE THAS THE SITE IS <br />NOT DISTURBED AND SHALL NOTIFY THE P.EGULATOR AUTHORITY. THE OPERATOR <br />SHALL INSUT,E THAT THE RESOURCE(S) IS PROPERLY EVALUATED IN TER?IS OF <br />THE NATIONAL REGISTER OF HISTORIC PLACES ELIGIBILITY CRITERIA (36 CFR <br />60.6). SHOULD A RESOURCE BE DETER?TINED ELIGIBLE FOR LISTING IN <br />CONSULTATION IdITH THE REGULATORI' AUTHORITY AND THE SHPO, THE OPERATOR <br />SHALL CONFER WITH AND OBTAIN THE APPROVAL OF THE REGUZAT'ORY AUTHOPITY <br />AND THE SHPO CONCERNING THE DEVELOPMENT AVD IMPLE°fENTATION OF ?fITIGATIG2~ <br />MEASURES AS APPROPRIATE.
