Simpson, Assistant State Engineer~Q U' <br />SUBJECT: Keenesburg Coal Mine {Permit No. C-028-81)/ Stipulation 116 - 4~'ater Rights <br />This is in response to your request that we comment on Coors' compliance with <br />Stipulation H6. Stipulation ~6 required that Coors develop a plan to mitigate <br />any depletions to tributary water that may occur as a result of the operation <br />of the Keenesburg Mine. Coors has joined the plan for augmentation operated by <br />the Ground Mater Appropriators of the South Platte, Inc. (GASP) which operates <br />a temporary plan for augmentation which has been approved by the State Engineer's <br />Office. <br />The appropriate contract documents have been signed by GASP and Coors. During <br />the current water year, Coors released 70 acre-feet from their Clear Creek storage <br />system to augment for the tributary water that was pumped from the Keenesburg <br />Kline Site. <br />This office expects to receive an annual report from Coors in February of each <br />year for as long as Coors continues to operate the Keenesburg h1ine. Coors plans <br />to meter all inflow water and rainfall runoff pumped from the pit during the pre- <br />vious year. This information will be presented in the annual report submitted to <br />this office. The amount of make-up water released during the previous year to <br />replace this tributary water intercepted will also be presented in the annual report. <br />In addition, Coors should indicate any releases that will be made during the current <br />year to correct for any shortages in make-up water that occurred during the previous <br />year. <br />Based upon the above referenced actions either already taken by Coors or that will <br />occur in the coming years, we feel that Coors is in compliance with Stipulation 116. <br />HDS/RLS:ma <br />cc: Jim Clark, Div.
