Roads - Rules 2.05.3(3), 2.07.6(2)(d>(iv) and 4.03
Kaiser Steel Resources disturbed a small area within 100 feet of the
Highway 69 right-of-way during reclamation of the sediment ponds and
associated diversions at C.C.M.C. No. 1 in March, 1991.
Kaiser Steel Resources solicited approvals for such a disturbance from
the Colorado Division of Transportation and Huerfano County following
receipt of Notice of Violation 92-008. Both agencies indicated that such
a disturbance was outside of their jurisdiction in letters received by
the Division on July 15, 1992. The Division provided an opportunity for
a public hearing on the issue in public notices printed in the
Huerfano Daily World on July 30, 1992 and August 7, 1992. The Division
received no requests for a public hearing following notification.
The Division finds that the disturbance and associated reclamation of the
segment of the north interceptor ditch which falls within 100 feet of the
outside right-of-way of Highway 69 will not adversely affect the
interests of the public or landowners.
The remainder of the 1983 Findings Document remains in effect. The
Division finds the application to be in compliance with the requirements
of this section.
CWB/ern
4530E
