<br />permit withoutThornton'spriorwrittenapproval. Aggregate will obtainThornton'swrittenapproval <br />prior to the release of any reclamation bond, which approval will not be unreasonably withheld. <br />a. Aooreoate's Access to the Property for Reclamation Purposes. Subsequent <br />to Closing and upon request made to Bud Hart, Thornton Manager of Water <br />Supply Treatment, or his designated successor, at least twenty-four (24) <br />hours prior to entry, Aggregate will be permitted to enter and have access <br />to the Property for purposes of complying and completing any reclamation <br />or other post mining work necessary under the Permits. In pertorming any <br />reclamation or post mining work necessary under the Permits, Aggregate <br />shall not destroy, damage, or injure the Property or any improvements on <br />the Property. <br />b. Augmentation Water for Unlined Ponds and Lakes. Aggregate shall be <br />responsible for any continuing water augmentation requirement for any <br />unlined ponds or lakes on the Property. <br />c. Insurance. Subsequent to Closing and so long as it has not been released <br />from the bonds and obligations under the Permits, Aggregate shall procure <br />and maintain in force, at its own cost, the following coverages: <br />Workers' Compensation Insurance as required by the Labor Code of <br />the State of Colorado and Employer's Liability Insurance. <br />Commercial General Liability Insurance with minimum combined <br />single limits of One Million Dollars ($1,000,060.00) each occurrence <br />and One Million Dollars ($1,000,000.00)general aggregate. The <br />policy shall be applicable to all premises and operations, The policy <br />shall include coverage for bodily injury, broad form property damage <br />(including completed operations), personal injury (including <br />coverage for contractual and employee acts), blanket contractual, <br />independent contractors, products, and completed operations, and <br />also include coverage for explosion, collapse, and underground <br />hazards. <br />iii. Automobile Liability Insurance with minimum combined single limits <br />for bodily injury and property damage of not less than One Million <br />Dollars ($1,000,000.00) for any one occurrence, with respect to each <br />of Aggregate's owned, hired or non-owned vehicles assigned to or <br />used in performance of the reclamation or other post mining work <br />necessary under the Permits. <br />Hammer <br />Option & Purchase Agreement <br />December 11, 2000 <br />Page 20 of 29 <br />
