Financial and Comoltance - Rule 2.05 <br />Information pertaining to the legal, financial and compliance requirements is <br />found in section 2 of the permit application. <br />Pursuant to Rule 2.07.6(2)(f), the Division finds that this operation does not <br />involve the surface mining of coal where the private mineral estate to be <br />mined has been severed from the private surface estate. <br />Pursuant to Rule 2.07.6(2)(8), the Division finds that the applicant does not <br />own or control any operations which are currently in violation of any law, <br />rule, or regulation of the United States, or any State law, rule, or <br />regulation enacted pursuant to Federal law, pertaining to air or water <br />environmental protection or any provision of the Surface Mining Control and <br />Reclamation Act or the Colorado Surface Coai Mining Reclamation Act. <br />Pursuant to Rule 2.07.6(2)(h), the Division finds that the applicant does not <br />control and has not controlled any mining operations with a demonstrated <br />pattern of willful violations of the Act of such nature, duration, and with <br />such resulting irreparable damage to the environment as to indicate an intent <br />not to comply with the provisions of the Act. <br />Based on the information in the permit application, this section is in <br />compliance for both Eagle Mines No. 5 and 9. <br />V. Geology - Rules 2.04.5 and 2.04.6(2) <br />Geologic information within the permit application can be found on pages <br />III-5 and III-8 to III-40c; Figures III-1, III-2a to 2h, III-7 to III-17; <br />Tables III-1 to III-4; Maps III-1, III-2, III-3, III-4, III-6 to 6b, III-11; <br />Plates III-la to le; and in Appendices III-8a, III-8d, III-15 and III-17. A <br />summary of the geology is contained in the Description of the Environment and <br />sub-section C of Section VIII, Probable Hydrologic Consequences and Cumulative <br />Hydrologic Impact Study, within this findings document. <br />The applicant provided one analysis of the "P" seam roof, coal and floor <br />materials in the January 30, 1484 submittal. No potential acid-forming, <br />toxic-forming, or alkalinity-producing materials were identified, but this <br />single analysis may not be representative of all strata to be disturbed during <br />the 5-year permit term in the Eagle No. 9 Mine. The Division requires a <br />minimum of one core analysis or channel sample per square mile of mine <br />
