Lonµ <br />^~rision D~reaar <br />The Division has reviewed MCC's December 1, 1997 letter regazding the removal of subsoil <br />from the pile on top of the Lower Refuse Pile (LRP) at the West Elk Mine. We had requested <br />additional information to demonstrate that adequate subsoil is available for reclamation of the <br />LRP. In addition to the information provided by MCC, we are still in need of the following: <br />Page 6 of Exhibit 51 indicates that at the current phase of the LRP (Phase V), 11,374 to 15,165 <br />cy of subsoil will be required to reclaim the pile. Table 36, on page 2.05-52 of the permit <br />application indicates that the "Subsoil Stockpile -Sylvester Gulch" is dedicated to the "Lower <br />Refuse Pile Area -Phases I-IV and Road Relocation." The volume of this pile is reported to be <br />29,550 cy. <br />Is the subsoil in this stockpile also dedicated to Phase V reclamation of the LRP? If so, <br />the table should be revised accordingly. [f not, MCC needs to clarify where the subsoil <br />for Phase V reclamation of the LRP is located and how much subsoil is currently <br />available for this purpose, and revise the permit text accordingly. <br />2. Is the volume listed for the Sylvester Gulch Subsoil Stockpile (29,550 cy) accurate at this <br />time? <br />3. How much material will be required for the road relocation referenced in the stockpile <br />description? <br />In the course of this review, it became apparent that Map 57, Topsoil Replacement Plan, has not <br />been revised along with recent permit application revisions which increased disturbed areas. <br />MCC needs to provide a revised Map 57.
