This document contains the findings and proposed decision for a Request for Transfer of Coa] Permit <br />and Succession of Operator. The request was received by the Colorado Division of Minerals and <br />Geology (the Division) on 21 October 2002 and proposes to transfer permit no. C-80-003 from the <br />current permittee, HG Coal Company, to Hayden Gulch Terminal, Inc. (HGTI). The application was <br />submitted and reviewed pursuant to section 2.08.6 of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining. <br />On 21 October 2002 the Division received a Request for Transfer of a Coal Permit and Succession of <br />Operators from the HG Coal Company. The initial application was properly executed as required by <br />Rule 2.08.6(2)(b) and was called complete by the Division on 30 October 2002. As required by Rule <br />2.08.6(3), the Division received an Affidavit of Publication indicating that the proper legal notice had <br />been published in the Steamboat Pilot (Steamboat Springs, CO) on 3 November 2002. <br />The Division sent an initial adequacy letter to the Operator on 4 November 2002 with concerns <br />regazding identification of interests, issues in the Applicant Violator System (AVS) and the <br />replacement performance bond that was submitted with the request. The Operator responded to the <br />letter on 25 November 2002. On 2 December 2002 the Division sent out a second adequacy letter <br />regazding the replacement performance bond. The Operator responded to the letter on 12 December <br />2002. <br />The Division proposes to APPROVE without stipulations the Reguest for Transfer of Coal Permit and <br />Succession of Operator. <br />1. The Division finds that a properly executed Request for Transfer of Coal Permit and <br />Succession of Operator application form has been submitted to the Division in compliance <br />with Rule 2.08.6(2)(b). <br />2. The Division finds that a properly executed Coal Reclamation Bond has been posted by the <br />successor Operator and approved as follows: <br />Travelers Casualty and Surety Company of America Corporate Surety # <br />64S 103869264BCM in the amount of $27,437.27. <br />On 16 December 2002, the Division recalculated the remaining liability at the HG Mine and <br />determined that the corporate surety of $27,437.27 is adequate to complete reclamation at <br />the site if the permit is revoked and the bond forfeited. <br />The Division finds that the Identification of Interests information required by Section 2.03.4 <br />has been properly submitted, reviewed and deemed adequate as required by Rule <br />2.08.6(2)(b)(iii). <br />
