Dept. of Nu.;:~,,, ;resources Dear Sirs: Our office represents Frank and Richard Ward and Ward Construction which periodically extracts sand and gravel from property owned by Frank and Richard Ward southeast of Loveland, Colorado. We enclose for your consideration a general area map indicating the area where the sand and gravel is extracted. As was the case with regard to another client of our office about whom we contacted you on October 4, 1977, Frank and Richard Ward only recently have become aware of the requirements of the Mined Land Reclamation Acts of 1973 and 1976 and have likewise only become aware of the Compliance Program which the board has instituted for unpermitted opera- tions. As was indicated in my earlier letter, I have talked with James Schmeiding of the Hoard staff and with Lynn Obernyer of the Attorney General's office about the procedure we should follocv at this point with regard to such operations and this letter is a follow up to their suggestions. We have only recently received this preliminary map from the engineers and are, therefore, submitting it at this time. The approximate number of disturbed acres in the operation of Ward Construction is seven (7) acres. The type of mining operation being conducted is open pit, sand and gravel extraction and the operation is currently active although extraction only takes place at intermittent periods throughout the year. Ex- traction has taken place from the location for more than twenty (20) years. We are currently in the process of compiling required infor- mation concerning the Reclamation Program with regard to this sand and gravel operation and will be submitting that as soon as is reasonably possible. And as we noted in our letter of October 4, we have been informed that the Board has worked closely with those operators who have come to the Board in good faith and who have diligently attempted to bring them- selves into compliance. If further information is needed to this operation at this time or if an appearance before the Board would be necessary, please contact me at your earliest convenience.
