Dept. of Nu.;:~,,, ;resources <br />Dear Sirs: <br />Our office represents Frank and Richard Ward and Ward <br />Construction which periodically extracts sand and gravel <br />from property owned by Frank and Richard Ward southeast of <br />Loveland, Colorado. We enclose for your consideration a <br />general area map indicating the area where the sand and gravel <br />is extracted. As was the case with regard to another client <br />of our office about whom we contacted you on October 4, 1977, <br />Frank and Richard Ward only recently have become aware of the <br />requirements of the Mined Land Reclamation Acts of 1973 and <br />1976 and have likewise only become aware of the Compliance <br />Program which the board has instituted for unpermitted opera- <br />tions. As was indicated in my earlier letter, I have talked <br />with James Schmeiding of the Hoard staff and with Lynn Obernyer <br />of the Attorney General's office about the procedure we should <br />follocv at this point with regard to such operations and this <br />letter is a follow up to their suggestions. We have only <br />recently received this preliminary map from the engineers and <br />are, therefore, submitting it at this time. <br />The approximate number of disturbed acres in the operation <br />of Ward Construction is seven (7) acres. The type of mining <br />operation being conducted is open pit, sand and gravel extraction <br />and the operation is currently active although extraction only <br />takes place at intermittent periods throughout the year. Ex- <br />traction has taken place from the location for more than twenty <br />(20) years. <br />We are currently in the process of compiling required infor- <br />mation concerning the Reclamation Program with regard to this <br />sand and gravel operation and will be submitting that as soon <br />as is reasonably possible. And as we noted in our letter of <br />October 4, we have been informed that the Board has worked <br />closely with those operators who have come to the Board in <br />good faith and who have diligently attempted to bring them- <br />selves into compliance. If further information is needed to <br />this operation at this time or if an appearance before the <br />Board would be necessary, please contact me at your earliest <br />convenience. <br />
