S-1 <br />Glenwood Springs, CO 81601-4272 <br />Re: 2002 Vegetation Sampling Data <br />Rimrock Mine (Permit No. C-89-074) <br />Dear Mr. Johns: <br />Please find enclosed a copy of the 2002 vegetation data collected at the Rimrock mine <br />during early August of this year. <br />Unfortunately, the vegetation cover at the site is well below 90% of the cover standard of <br />41 %. The cover standard for the site was derived from actual baseline data collected on the <br />pit area prior to mine disturbance. At this point, the data would indicate the site is not where <br />it needs to be for a Phase II bond release, let alone a Phase III bond release. For Phase III <br />release, 90% of the standard must be achieved for the final two years of the liability period. <br />The good news is the production data collected (435 Ibs/acre) indicates the site is very close <br />to meeting 90% of the production standard of 463 Ibs/acre (90% of 514 Ibs/acre). Also, <br />although there is no shrub standard, the shrub density is very high at over 11,000 <br />stems/acre. We believe that the extended dry conditions are to blame for the limited amount <br />of vegetative cover this year.
