PROCEDURES AND SUMMARY OF THE REVIEW PROCESS Bear Coal Company's application for Phase I, II, and III bond release at the Bear No. 1 and 2 Mines was received by the Division on May 2, 1994. The application was deemed complete on July 5, 1994 ,after the Division received proof of publication of the applicant's public notice. Bear Coal Company published notice of the bond release application in the Delta County Independent once weekly for four consecutive weeks, beginning May 25, 1994. Bear Coal Company also notified land owners within and adjacent to the mine permit area, and other interested parties of the application for bond release, as required by Section 3.03.2(1). No written objections or requests for an informal conference regarding the bond release application were received by the Division. Comments were received from Pacific Basin Resources, a division of Oxbow Carbon and Minerals. Inc., owner of a portion of the area proposed for release. The letter stated that representatives of Pacific Basin Resources had visited their portion of the permit area, and found reclamation of the site to be acceptable. The Division scheduled and conducted an initial bond release inspection on August 3, 1994. The site inspection was conducted in accordance with Section 3.03.2(2). Tony Waldron and Steve Shuey of the Division conducted the site inspection. Mitch Rollings of the Office of Surface Mining and Henry Barbe of Mountain Coal Company attended the inspection.
