PROCEDURES AND SUMMARY OF THE REVIEW PROCESS <br />Bear Coal Company's application for Phase I, II, and III bond release at the Bear No. 1 and 2 Mines <br />was received by the Division on May 2, 1994. The application was deemed complete on July 5, <br />1994 ,after the Division received proof of publication of the applicant's public notice. Bear Coal <br />Company published notice of the bond release application in the Delta County Independent once <br />weekly for four consecutive weeks, beginning May 25, 1994. Bear Coal Company also notified <br />land owners within and adjacent to the mine permit area, and other interested parties of the <br />application for bond release, as required by Section 3.03.2(1). <br />No written objections or requests for an informal conference regarding the bond release application <br />were received by the Division. Comments were received from Pacific Basin Resources, a division <br />of Oxbow Carbon and Minerals. Inc., owner of a portion of the area proposed for release. The <br />letter stated that representatives of Pacific Basin Resources had visited their portion of the permit <br />area, and found reclamation of the site to be acceptable. <br />The Division scheduled and conducted an initial bond release inspection on August 3, 1994. The <br />site inspection was conducted in accordance with Section 3.03.2(2). Tony Waldron and Steve <br />Shuey of the Division conducted the site inspection. Mitch Rollings of the Office of Surface Mining <br />and Henry Barbe of Mountain Coal Company attended the inspection. Bear Coal Company was <br />represented by Basil Bear and !im Stover.
