t to(s)(c) (d) Except for Special l l l Operation Permit applications,
within ten (10) days after filing of the application with the Office,
publish a public notice in a newspaper of general circulation in the
locality of the proposed mining operation containing:
(i) name and address of Applicant;
(ii) location of the proposed mining operation by
section, township and range and street address where
applicable;
(iii) proposed dates of commencement and
completion of the operation;
(iv) proposed future use of affected land;
(v) location where additional information on the
operation may be obtained; and _
(vi) location and final date for submitting
statements of support or objections with the Office.
t to(s)(c) (e) Except for Special 111 Operation Permit applications,
tt2(9)(c> within ten (10) days after filing of the application with the Office,
mail or personally serve a copy of the Notice in Subparagraph
1.6.2(1)(d) to:
(i) all Owners of Record of surface and mineral
rights to the affected land; and
(ii) all Owners of Record of surface lands that are
within 200 feet of the boundary of the affected land.
tto(5~(e) (f) AS soon as designated by the Office, mail a copy
tt2(9)(c) thereof to any other Owners of Record who might be affected by the
proposed mining operation. The Office shall designate such owners,
if any, within one (1) week after the filing of the application. (Not
applicable to Special 111 Operation Permit applications.)
tto(5)(e> (g) ~ Prior to Office consideration of the application,
tt2(9)(c) submit proof of publication and proof of all required notices. Proof
of Notice may be by submitting return receipts of a Certified
mailing or by proof of personal service. An application will be
considered filed by the Office when the Applicant supplies the
proper application fee and a signed affidavit that all notices as
