Larry P• Koutten
Uivisiun of Niner.~lc f. CeoJcRy
1313 Sherman St.
Denver CC E0203
Uear Mr. Routten:
,:
Our understanding of. the Dec. 21, 1993, meeting wa;~ that you were going
to prepare the amended agreement and the proposed ]ette.- .c the board
for our review. Obviously, there was no meeting of the minds regarding
the letter.
Specifically about the letter, you only state that "the previous
modelling was in error". There is no indication of the ms~nitude of
error which is approximately 600Y,. You state that the undersized
culvert resulted in "some. problems". fde th'_nk that any reader of
the lector would mir~imi:.e the impact of the "problems".
Yon do mention that the DMG-Harrison-[Jestern-Corley agreement states
[!ra[ the Division determined that the actt,al cost will not exceed
$18,500, but you do not mention that there was no consCruction plan on
which to base that cost estimate. Further, the loe~ bid for the work was
not $29,000, but $?3,000.
Since you want us to co.:.r.:unicate any corrections to the Roard, we do not
believe that you have completed your pr.rt cf the agreement. We no
longer wish to go ahead with our ^.nggested compromise. We understand
now that any future agreement must be in writing. Do you }lave any
suggestions?
With regard to the D14G le"ter to the Vento Trust, there is a property
description for the. Puck Pond of the "Eft}t Sec 24". That same
description was used for the Vento Trust property. The Etiti of a sr_ction
does not exist. The Duck Fond is in the SEIyNEti and the NE'--tSFf~ Sec. 24.
The Vento Trust does not own any land in Sec. 24• they owr, the F4r', Sec.
19. Mr. Robinson was confused about the location.
W ~~~
W.D. Corley,
President
