August. There is no indication that subsidence impacts the surface water hydrology of the <br />area. Subsidence cracks in the channel bottom were not noted during the inspection. Due <br />to the 1 ~ or more years since longwall mining, it is unlikely that subsidence cracking <br />would be appazent to a visual inspection. Given the heavy vegetation, and the steep, rocky <br />slopes, any minor subsidence impacts would not be recognizable and, if present, appear to <br />have no appreciable affect on the environment. <br />Two areas of surface disturbance from the New Elk Mine have been incorporated into the <br />Golden Eagle permit azea, via Bond Release SL-02. (See also MR-79, New Elk Permit <br />#C-81-012) These two small areas aze reclaimed ventilation shaft locations both located <br />in the Left Fork of Apache Canyon. These two remote, isolated reclaimed areas have no <br />environmental impact on the immediate or surrounding azea. Reclamation liability <br />remains the responsibility of Basin Resources, Inc. <br />SUMMARY <br />In summary, Picketwire has submitted the proper documentation, and field inspection has <br />verified, that negative environmental impacts from subsidence are not present in the area <br />overlying the underground workings in the southern portion of the permit azea. The site <br />continues to be properly bonded for reclamation of all surface disturbance and no change <br />in reclamation cost liability is granted by this proposed decision. Based on the <br />observations and findings as detailed above, the Division proposes to approve <br />Picketwire's request for a release of reclamation liability of areas overlying underground <br />workings south of the green dashed line, as depicted on Figure 1 of the application and as <br />attached as Appendix A to this document. The bond held by the Division is currently in <br />excess of the approved reclamation liability estimate. <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public hearing before the Mined Land Reclamation Boazd <br />in accordance with Rule 3.03.2(6). Public notice of this proposed decision will be <br />published once a week for two weeks in the Chronicle-News as soon as possible. <br />Requests for public hearing must be submitted to the Division in writing within thirty days <br />of the first publication of the public notice.
