Kama, <br />Division Director <br />In our letter of March 26, 1991 we requested confirmation of Eastside's intent <br />to operate the Eastside Mine in compliance with the limited production level <br />of 857 tons per year as authorized by Garfield County as apre-existing <br />non-conforming use. Our understanding, based an Mark Bean's letter of March <br />12, 1991 and your letter of April 3, 1991, is that Eastside will operate at <br />the limited production level until a new special use permit is approved by the <br />Garfield County Commissioners. Please advise us if our understanding is <br />correct or not. Please also address when you plan to initiate operations, If <br />no operations are anti ci gated to begin wi thin the next 30 days, a noti fi cation <br />of temporary cessation should be submitted pursuant to Rule 6.30.1(2). Please <br />address these concerns by .no later than May 15, 1991. <br />We further requested in our March 2fi, 1991 letter that Eastside submit a <br />technical revision application addressing domestic use of Farmers' Ditch water <br />and potential impacts of the Eastside Mine on that use by May 1, 1991, You <br />have not submitted such a revision but have stated that water monitoring <br />conducted since original permit issuance has not indicated any mine related <br />impacts to the quantity or quality of receiving waters. We have reviewed the <br />data and concur with your conclusion, You further pointed out, and we have <br />confirmed that, in October, 1985, fn forma ti on was submitted to the Division <br />which indicated that approved uses of Farmers' Irrigation Ditch water include <br />both irrigation and domestic use during the irrigation season, <br />As long as the Eastside Mine is operated in compliance with the MLRD permit <br />and other applicable state and local requirements, we believe that the current <br />projections in the Eastside permit application and the Division's Probable <br />Hydrologic Consequences Assessment remain valid. Water quality impacts are <br />expected to be insignificant and are predicted to have no effect on the <br />STATE OF COLORADO <br />
