r . • <br />r <br />t <br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />In the matter of: The Corley Company ) Landowner Petition for <br />The GEC Strip Mine ) Declaratory Order <br />Revoked Permit No. C-81-037 ) <br />To: The Corley Company and all other persons engaged in or owning or controlling the property <br />upon which lies the former GEC Strip Mine coal mining operation located in portions of Sections 24 <br />and 25, Township 20 South, Range 70 West, and portions of Sections 19 and 30, Township 20 <br />South, Range 69 West, of the 6th P.M., in Fremont County, Colorado. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board by <br />C.R.S. 34-33-101 et• sea•, C.R.S. 24-4-105, and Rule 1.14 of the Regulations of the Board for <br />Coal Mining, the Board hereby makes the following findings of fact: <br />On November 17, 1993, the Board held a Formal Public Hearing to consider a <br />Landowner Petition for Declaratory Order, filed by The Corley Company ("Corley") <br />on October 18, 1993, to resolve questions concerning bond release for the Canon Coal <br />Corporation on lands owned by Corley. <br />2. Corley presented evidence and/or testimony demonstrating that: <br />a. Corley, on September 20, 1993, submitted to the Division of Minerals and Geology <br />("The Division") a letter dated September 19, 1993 requesting information regarding <br />the reclamation bonds submitted by Canon Coal Corporation for coal mining <br />operations that existed in T20S, R70W, 6th P.M., in Fremont County, Colorado. <br />b. Corley, by October 26, 1993, had not received a response to that letter and <br />subsequently submitted its Petition to the Division on October 18, 1993. <br />The Division presented evidence and/or testimony demonstrating that: <br />a. The Petition for Declaratory Order by Corley appeared to be a request to the Board <br />that the Board order the Division to respond to the September 19, 1993 Corley letter, <br />rather than a request by a petitioner to determine the applicability to the petitioner of <br />any statutory provision or of any rule or order of the Board. <br />
