We recessed for our <br />annual vacation from 12/18/87 until January 5, 1988. Upon ~ <br />x'e:turn I reveiwed the material you sent. At this time we are <br />stall unable to secure the Compliance with Local Zoning and the <br />Seuxne of Legal Right-To-Enter. <br />I spoke with Mark Gebhart yesterday roaming as I have not <br />received as yet the information he was going to send ~ <br />concerning the E1 Paso Planning Commision, and their application <br />requirements. As I stated in roy earlier letter this process with <br />E:L Paso County is ninety days from their receipt of the packet. <br />Murk stated that he thought he had sent the packet but in <br />reveiwing his notes could find no record of it. He will be <br />sending the necessary information at this time. <br />I spoke with Brian Borge at the State Highway Department in <br />A~eblo this afternoon. He stated that at this time everything <br />1<~oked very favorable for issuing the right of way permit. He is <br />going to send me a letter stating this and advising us some <br />passible utility companies to contact concerning the easemVnts. <br />He also stated that it could still be some time before the actual <br />permit is issued, which also delays the E1 Paso County Hearing. <br />I plan to complete the application packet for the Reclamation <br />Only Permit and return to you within the next 30 days however it <br />will not be complete until the above mentioned matters have been <br />solved. <br />We would like to request that the Board consider a continuation <br />allowing us sufficient time to handle this thmueh the normal <br />channels. Considering all the seperate agencies that are involved <br />in this, We feel that we have indeed made significant headway in <br />this matter. <br />I would once again like to point out that we have conducted no <br />operations there since our Notice of Possible Violation.
