For a detailed breakdown of the <br />different leases, please see section 2.03.6 of the permit. <br />The Colorado Mined Land Reclamation Division proposes to approve with stipulations an <br />application for the renewal and revision of a valid existing permit which entails the addition of an <br />additional 260 acres, more or less, to the existing permitted acreage. <br />The application was submitted by Mr. Brad Gosche and Mr. Tom Bird for the King Coal Mine. <br />This decision is based on a fording that the operations will comply with all requirements of the <br />Colorado State Program as found in the Colorado Surfxe Coal Mining Reclamation Act, C.R.S. <br />34-33-101 et seq., and the Regulations promulgated pursuant to the Act. If no requestfor a formal <br />• hearing is made within thirty (30) days of the first publication of the issuance of this proposed <br />decision, then this decision becomes final and the permit will be issued The permit application, <br />all supporting documentation and any stipulations or conditionswill become a binding part of the <br />permit. <br />All previous conditions and stipulations have been complied with, however, three additional <br />stipulations have been introduced, these are: <br />Stipulation 11: As soon as possible, have the directors of National King Coal, LLC, submit <br />information that indicate Applicant Violator System (AVS) problems associated with coal mine <br />Pemit no's. 5004084 and 5004381 in West Virginia have been resolved. <br />Stipulation 12: Within 90 days, submit a new Regional Hydrology Map which includes surface <br />water monitoring stations, MSL depths of water elevations for each of the wells within one mile <br />of the permit boundary (if available), and elevation contours of the Point Lookout Sandstone <br />aquifer <br />Stipulation 13: Within 90 days, submit a technical revision to update the permit boundary and <br />include areas which are affected by the angle of draw principle. <br />• <br />2 <br />
