ec ' • The following findings and specific approvals are required by Rule 4: I. Roads -Rule 4.03 A. Haul Roads 1. The applicant has provided relevant information concerning the pre-1995 contracted haul road that shows the road meets the performance standards of Rule 4.03.1 2. The Division proposes to approve the retentionof the haul road depicted on Map No. C-4 since it is compatible with the approved post-mining land use, and a request for its retention was submitted by the landowner. (4.03.1(1)(f)(I)). B. Access Roads • 1. The landowner has requested the retention of the access road depicted on Map No. C-4. It's retention is compatible with the approved post mining and historic land use of agriculture (ranching). Therefore the Division proposes to approve retention of the access road. (4.03.2(I)(f)). II. Support Facilities -Rule 4.04 Information on mine support facilities is found in Section 2.05.3 of the permit and are depicted on Map C-4. A summary is found in the Summary Section of this document under "Description of Operations and Reclamation Plan". Specific fmdings for Rule 4.04 are not applicable. III. Hydrologic Balance -Rule 4.05 A. With the exception of the Small Area Exemption listed below, all disturbed area drainage passes through one of two existing sediment ponds. Discharges from theme ponds are monitored to verify compliance with water quality standard and effluent limitations (4.05.2(2)). 1. The Division proposes to grant a small azea exemption from use of sediment ponds due to the limited size of the area and due to the fact that ponds and treatment facilities are not necessary for the drainage to meet the effluent limitations of Rule 4.05.2 and applicable State and Federal water quality standards for receiving streams and also due to the fact that no mixing of surface drainage with a discharge from underground workings will occur.
