The third permit renewal process was initiated by the Division by notifying CYCC that a <br />renewal application for a fourth permit term was due by June 14, 1996. CYCC submitted a <br />complete permit renewal application on June 14, 1996. On October 23, 1996 CYCC <br />requested an extension of the proposed decision date until December 16, 1996. The Division <br />sent a preliminary adequacy letter on November 29, 1996 to CYCC identifying items within <br />the permit that needed updating or clazification. On December 13, 1996, CYCC requested a <br />60-day extension of the decision date to February 14, 1997. CDMG received initial reponses <br />to some of the November 29, 1996 adequacy concerns on January 31, 1997. Additional <br />responses to the Division's adequacy concerns were received on Februazy 6, 1997. On <br />February 13, 1997, CYCC requested an additional extension until March 21, 1997 to allow for <br />the Division to review CYCC's submittals, and allow CYCC to complete their response to the <br />remaining adequacy concerns identified in the Division's November 29, 1996 letter. Final <br />adequacy responses were received by the Division on March 20, 1997. Subsequently, on <br />March 21, 1997, CYCC requested a decision extension until March 28, 1997. The Division <br />proposed to conditionally approve the Permit Renewal No. 3 on March 26, 1997. Upon <br />approval, the issuance date will be December 14, 1996. <br />Two new stipulations are being added to the permit as a result of this permit renewal. <br />Stipulation No. 27 is being added to the permit as a result of querying the Applicant/Viola[or <br />System on September 9, 1996, November 26, 1996, December 12, 1996, February 18, 1997, <br />and February 24, 1997, with final resulting system recommendations of "Deny". Upon <br />consultation with the OSM in accordance with the Division's Memorandum of Understanding, <br />OSMRE provided a "Conditional Issue" recommendation with [he following permit condition: <br />STIPULATION NO. 27: <br />The permit is issued subject to final resolution of the ownership and control rules <br />challenge before the D.C. Circuit Court of Appeals. On January 31, 1997, the Court of <br />Appeals rendered a decision unfavorable to OSM's ownership and control regulations. <br />Once all avenues of judicial review have been exhausted, [his permit will be reviewed to <br />determine if it is in compliance with applicable requirements. <br />Current soils maps were not submitted delineating the locations and volumes of currently <br />existing topsoil stockpiles and windrows. Therefore the following stipulation will be included <br />with this renewal: <br />STIPULATION NO. 28: <br />Within 30 days of Permit Renewal No. 3 proposed decision, CYCC will provide an <br />updated map (or maps) depicting current location and volumes of remaining topsoil <br />stockpiles. <br />5 <br />
