Cottony <br />Division Director <br />Natural Resource Trustee <br />On August 1, 2006, I contacted Greg Janus at (970) 884-2426. Mr. Janus had recently left a <br />message at the Denver Office regarding a possible illegal mining operation near Bayfield in La <br />Plata County. <br />Mr. Janus indicated that there was a crusher located at the intersection of CR 501 and 502, <br />operated by Neil Excavation, and that the crusher was within 250 feet of his residence. Mr. <br />Janus stated that he thought the crusher had a 250-foot setback requirement. Mr. Janus <br />clarified that he did not want to submit a complaint but was only inquiring, on behalf of his <br />neighbor, Mr. Bradford, as to whom Mr. Bradford could call regarding the mining operation <br />located at the intersection of CR 501 and 502. Mr. Janus indicated that Mr. Bradford believed <br />that portions of the mining activity might be located on his lands, illegally. I informed Mr. Janus <br />that he could give my name and phone number to Mr. Bradford as an appropriate person to <br />contact regarding the referenced mining operation. <br />DMG records indicate that the Texas Creek Gravei Pit, Permit No. M-1980-143, is located at the <br />intersection of CR 501 and 502 and that the permit is issued to Neil Excavation.
