<br />i i <br />-5- <br />Proposed Decision <br />The Division finds, based on the findings contained in this document, that the <br />Northern No. 1, Rienau No, 2, and refuse disposal areas are eligible for a <br />maximum of 60 percent release for successful completion of backfilling and <br />grading. Specifically excluded from the release are all sediment ponds, the <br />two minor slide areas at Northern No: 1; and all monitoring wells and drill <br />holes. <br />The Division also finds that the Wilson-Loudy Loadout is eligible for complete <br />bond release, In accordance with Rule 3,03,1(2)(b), 85 percent may be <br />released as a result of achieving the revegetation requirements of 4.15.10. <br />Retention of the remaining 15 percent is not appropriate; as Elam Construction <br />is now responsible for bonding the area in conjunction with their gravel pit <br />operation, <br />Rule 3.03,1(3)(d) requires the Division to retain at a minimum, sufficient <br />bond to complete the approved reclamation plan: The Division has reviewed the <br />original bond calculations, and finds that sufficient bond is held by the <br />Division to allow for the proposed release as described above. <br />In summary; the Division proposes to release 60 percent of the liability of / <br />the Meeker Area Mines for backfilling and grading, and fully release liability (/ <br />for the Wilson-Loudy Loadout.
