<br />-a- <br />powerline, shop and concrete pads at Northern No. 1 have been <br />retained for use by the land owner. The only reclamation work <br />remaining is removal of several sediment ponds and repair of some <br />minor slide damage at Northern No. 1. In addition; the Division <br />has been unable to confirm the sealing of all monitoring wells and <br />drill holes: The proposed partial bond release approval by the <br />Division does not include any of these remaining items. <br />B. Phases I and II - For the Wilson-Loudy Loadout, the operator has <br />requested complete release of the remaining bond. <br />In March, 1987 the Mined Land Reclamation Division granted permit <br />approval for E]am Construction to operate a gravel pit which <br />encompasses the loadout area. This confirmed the "Industrial" <br />post-mining land use approved for the loadout. Under this use, the <br />revegetation requirements of Rule 4.15:10 have been met, as the <br />ground cover of living plants is sufficient to control erosion on <br />site. In addition, as Elam Construction is now responsible for <br />bonding this area under their approved mining permit, the Division <br />finds that Enron Coal is no longer responsible for bonding this <br />area: <br />
