Under this agreement, Harrison Woatern would make a <br />monetary payment to the Division in the amount of $18,500, which <br />would be used to construct n new diversion ditch and culvert sa <br />noted below and finish reclaiming the Harrison Western's bonded <br />wren. In return, the State would release Harrison Western's <br />performance bond. <br />Tho second agreeato3lt would be between The Corley Company and the <br />Division. Under this agreement, the Division would agree to <br />replace, or arrange for the replacement of, the existing <br />diversion ditch and culvert between the unnamed creek and the <br />Magpie-Diversion with a new ditch and culvert. <br />On the basis of these two agreements, The Corley Company is <br />prepared to enter into a settlement agreement with Harrison <br />Western i.n order to settle the suit between the parties thet <br />arose frc® the construction of the existing ditch and culvert <br />last Bummer. <br />To this end, we would urge the !Lined Land Reclamation Board to <br />direct the Division to work with The Corley Company and Harrison <br />FEB z5 '93 9:39 719 Sao 9044 PRG..00° <br />
