-35- <br />Stipulation No. 16 <br />WITHIN 90 DAYS OF PERMIT ISSUANCE, THE PERMITTEE MUST SUBMIT <br />A PLAN TO THE REGULATORY AUTHORITY FOR APPROVAL PROPOSING THE <br />INSTALLATION OF A STRUCTURE THAT WOULD DEMONSTRABLY DISSIPATE <br />THE ENERGY OF FLOW IN THE CHANNEL SUCH THAT EROSION OF THE <br />CHANNEL WILL NOT OCCUR. <br />Upon termination of mining, Salt Creek Mining Company proposes to return the Loma <br />loadout facility to the land use which existed prior to the coal loadout <br />operation (storage and rail loading facility). This is specified in Article 21 <br />of the lease agreement between the applicant and the D&RGW Railroad Company <br />(see Exhibit C-VIII, Appendix C, Volume IV of the application). A11 structures <br />will be removed. Coal will be removed from the site and deposited at the <br />McGlone or Munger Canyon site to be covered during reclamation. The surface will <br />be graded to a smooth condition. <br />With the acceptance of the above stipulation, the operation is in compliance <br />with the requirements of this section. <br />XVIII. Coal Processing Waste and Non-Coal Processing Waste - Rules 2.05.3(8) <br />2.05.4(2)(f), 4.10 and 4.11 <br />Salt Creek Mining Company has not proposed the installation of any coal processing <br />facilities at the mine. No coal processing waste or non-coal processing waste <br />will be produced by the operation. The requirements of this section do not <br />apply. <br />XIX. Mine Facilities, Coal Han dline Facilities, Support Facilities - <br />Rules 2.05.3(3), 2.05.3(7) and 4.04 <br />Pertinent information regarding facilities at the mine site are given in Sections <br />2.2 and 2.3.4 of Volume I of the application. The facilities planned for the <br />mine are the mine office, vehicle storage facilities, primary mine fan, bulk <br />rock dust storage facility, power generation equipment, conveyor gantry, portable <br />staging/crushing unit, sediment ponds, roads and the proposed development waste <br />storage pile. The roads, sediment ponds and development waste storage pile are <br />discussed in other sections of this document (Sections XX, V and XVII, <br />respectively). <br />The applicant proposes cut slopes and embankment slopes similar to those adjoining <br />the haul road for the portal bench area of the Munger Canyon Mine. The portal <br />bench area also constitutes a "steep slope mining area." All proposed fill <br />slopes are to be graded at 2:Z (horizontal to vertical) and are, therefore, <br />acceptable. Cut slopes proposed within the portal bench area are limited to <br />1.5:1 (horizontal to vertical) in lower bedrock materials. These cut slopes <br />are in compliance, therefore, with the permanent program regulations. <br />The coal loadout facility is located approximately 2I miles from the mine site <br />along the D&RGW Railroad siding near Loma, Colorado. Approximately 5.6 acres of <br />disturbance is associated with the facility. Structures at the loadout include <br />four coal loading ramps and five coal stockpile areas which will accommodate a <br />maximum of 4,000 tons of coal. An agreement between Mesa County and Salt Creek <br />19ining Company, as stipulated in the Conditional Land Use Permit, limits the <br />
