"(1) No person shall permit emission of air pollutants f om, or construc-
tion or alteration of arty facility, process, or activity xcept residen-
tial stnrctures fm m which air pollutants are, or are to e, emitted un-
less and until an air pollutant emissions notice has been filed with the
Division with respect to such emission. A revised emissi ns notice shall
be filed whenever a significant change in emissions is an icipated or has
occurred. The commission shall exempt those sources or c tegories of
sources which it determines to be of minor significance f om the require-
ment that an air pollutant emissions notice be filed."
"(4) No person shall construct or substantially alter a building,
facility, structure, ar installation, except single famil residential
dwellings, or install arty machine, equipment, or other de ice, or commence
the conduct of any combinations thereof, or commence oper tions of any of
the same which will or do constitute a new stationary sou a or a new
indirect air pollution source without first obtaining or suing a valid
permit therefor from the division, board, or commission, s the case may
be; except that no permit shall be required for new indir ct air pollution
sources until regulations regarding permits for such sour es have been
promulgated by the commission. The commission shall eats lish rules,
regulations, and procedures in accordance with the provis ons of this
article for the granting or denial of permits which shall be in conformity
with the purposes of this article, as set forth in Sectio 25-7-102, but
in no event shall regulations governing indirect air poll tion sources be
more stringent than those required for compliance with th federal act and
final rules and regulations adopted pursuant thereto. Su h procedures
shall include, but not be limited to, the £ollawing:..."
It has come to the attention of the Air Pollution Control Division that you
plan to operate a granite, amethyst, silver and gemstone mine on q0 acres in e
portion of Sections 9, 10, and 15, T14S, R100W, Mesa County, olorado. A
review of the Division's Permit files indicates that a permit has never been
issued for this operation.
