Tie Board shall designate such owners, if any, within one <br />month of the filing of the application. <br />(5) Prior to Board consideration of the application, submit proof of <br />publication and proof of mailing of all required notices by certified <br />mail with return receipt requested where possible. <br />L.23 Upon filing a completed application and receipt of all fees due, <br />written notice of the date, time and place set for consideration of <br />the application shall be made by the Board (not more than 90 days <br />after filing), to the following parties: <br />(1) The operator, oy mail, <br />(2j Any county 'in which the proposed mining operation is to be <br />located, by mail, and <br />(3) Any municipality within two miles of the proposed mining <br />operation, by mail." <br />Copies of their public notice(s) is attached. <br />Dn December 21, 1977, the Mined Land Reclamation Board conducted a public <br />nearing in Colorado Springs co consider the permit application. Many people <br />attended this hearing and much testimony was provided. Because of questions <br />raised reyardiny reclamation, the Board voted to grant a continuance of _he <br />hearing until the operator could provide sufficient information to satisfy the <br />concerns raised. Dn March 26, 1980, the Board reconvened the hearing in <br />Colorado Springs (after providing public notice) to consider the Pikeview and <br />other Castle Concrete applications pending. Hundreds of people attended this <br />meeting. After consideration of the matter, the Board determined that the <br />application met the require;nents of the Act and that reclamation could be <br />achieved. They, thus, voted to approve the application (140 acres). <br />The application was a~iended in May, 1982, to add approximately 54 acres. <br />I Hope that this information is of some help to you.
