<br />Therefore, it is the opinion of the Division that the information contained in the WestWater report does <br />ilot contain any facts that would reverse the recommendation of the Division that the Board reconsider <br />their decision of October 30, 2003 to prohibit mining at the Haidorson site until one year of groundwater <br />level data from the site can be supplied to the Division for review, and should consider allowing the <br />operator to mine to a limited depth of 13 feet until the groundwater level data can be supplied and the <br />groundwater conditions can be further analyzed. The additional commitment by the operator to cease <br />mining in areas where groundwater reaches within 25 feet of the ground surface is a further protection <br />that groundwater should not be exposed and impacts of the mining operafion on the hydrologic balance <br />will be minimized at the site. <br />
