111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />1995. Mr. Every stated that he believed the deadline <br />could be met by MCC, and Mr. Mautz stated that he agreed <br />with this date. <br />2. There is a slide blocking the Lone Pine Gulch road below <br />the cabin. MCC has surveyed the area and believes that <br />the wet spring caused the slide and not subsidence <br />because the road did not move. Apparently, this is the <br />second time this year the slide has blocked the road. <br />MCC did clear the slide when the slope failed the first <br />time. They (MCC) tried not to oversteepen the cut slope, <br />as it was thought this may worsen the problem, and spent <br />a day working on the road. According to Mr. Mautz, the <br />area slid the next day. Mr. Every said that the <br />contractor believed the material to be too dry to slide. <br />Mr. Mautz wants MCC to fix the road because that is what <br />they said they would do. Mr. Every said that they agreed <br />MCC would spend a day working on the road. The slide <br />appears to be localized, but aerial photographs will be <br />reviewed to determine the extent of the failure. <br />3. The third area of concern is located further dPwn the <br />Lone Pine road. The road is quite muddy from springs <br />that flow across and down the road. Mr. Every and Mr. <br />Mautz both agreed that the way to solve the problem is to <br />cut a ditch along the inside of the road. The source of <br />the spring could not be found off the road. The spring <br />may come from under the road. These springs appear to be <br />localized and not the result of operations conducted by <br />MCC. <br />4. Further down on the Lone Pine road, four culverts have <br />been installed. MCC installed the four culverts. The <br />lower three culverts are functioning. Mr: Mautz's <br />concern is with the upper culvert. It appears the <br />equipment operator may have been a little sloppy when <br />installing the culvert. There is dried material, which <br />was once probably very wet, blocking the culvert. The <br />Division recommended that MCC fix the problem as it <br />appears Mr. Mautz's concern is a.result of MCC's work. <br />5. Mr. Mautz mentioned that he can hear noise from the fan <br />in Lone Pine Gulch at his house. Mr. Every informed me <br />that MCC has recently completed a noise survey (similar <br />to the one completed at the time the fan was permitted) <br />but was unaware of the results. <br />2 <br />
