Dear Mr. Walker: July 22, 1998 The purpose of this letter is to provide the Colorado Division of Minerals and Geology (CDMG) with a written waiver from the Durham Ranch of the 24 hour blasting notice requirements for [he Colowyo Coal Company L. P. mine. Recently, Mr. Jim Kiger, Sr. Environmental Engineer of Colowyo explained mama of the blast reporting requirements imposed upon them by the CDMG regulations. As you are aware, among their many requirements are the ones where Colowyo must 1) provide the Durham ranch with a copy of the annual republished blasting notice in the Craig Daily Press if the described blasting area is within one-half mile of the Durham residence; 2) advise the Durham ranch how to request an additional pre-blast survey and 3) provide notification to the Durham ranch of no less than 24 hours prior to a blast for those affected blast areas which are located within one-half mile of the Durham ranch dwellings. Jim explained that the CDMG rules allow for a variance from the 24-hour reporting requirement and requested that the Durham ranch provide such a written waiver to the CDMG. After 20 years of living near the Colowyo mining operation and their blasting at 4:00 P.M. nearly every day, we believe that such a 24-hour reporting requirement by Colowyo is unnecessary. We, therefore, wish to provide this complete waiver to Colowyo for the performance of this 24-hour reporting requirement. We also recognize that submittal of this waiver does not preclude our request to CDMG at some future date that this reporting requirement be reestablished.
