<br /> <br />3. On completion of such mining operation and utilization of its conveyor system <br />CAMAS agrees to restore the Fulton Irrigation Ditch, roadway and Bull Seep Ditch <br />and other such property impacted by the conveyor system to its original condition <br />that existed prior to such crossing. <br />4. The bridge across Fulton Ditch to be constructed by CAMAS must first meet the <br />approval of the Fulton Ditch and must be a freestanding crossing bridge without <br />interfering with the flow of water in the irrigation ditch of Fulton. Employees of <br />Fulton shall have the right to utilize such bridge due to the installation of the <br />conveyor system, which prevents the Fulton employees from crossing such <br />conveyor system by automobiles or trucks to maintain the ditch by utilizing its <br />maintenance road. <br />5. As further consideration for such crossing permits and consent to Reclamation <br />Permit CAMAS agrees as follows: <br />a. To install a refrigerated air conditioner system in the Fulton company house <br />located approximately 250 feet from the conveyor system to correct and offset any <br />noise increase caused by such conveyor system. <br />b. To grant to Fulton a bill of sale to the bridge across the Fulton Ditch constructed <br />by CAMAS and an easement from the Fulton roadway to such bridge upon <br />completion of the gravel operation and conveyor system. <br />c. Convey to Fulton that pazcel of land situated easterly of the parcel owned by the <br />Fulton Irrigation Ditch Company and Westerly of the Bull Seep Canal as described <br />on the plat identified as FULTON DITCH "MINING LIMITS PLAN", incorporated <br />herein by reference upon the completion and tem>ination of the mining operation <br />and the conveyor system. The Deed shall contain a reservation of sand and gravel <br />rights to CAMAS with a restriction that the sand and gravel shall not be mined <br />without the express written consent of Fulton. <br />d. CAMAS intends to attempt to rezone their property including that portion to be <br />conveyed to Fulton. Fulton agrees not to interfere with CAMAS's attempt to zone <br />the property to be conveyed to Fulton. <br />e. Granting to Fulton a 15-foot easement adjacent to and along the easterly <br />boundary of the Bull Seep Canal as the Bull Seep Canal crosses that certain pazcel of <br />real estate being purchased by CAMAS on which its plant operation and stock pile <br />azea is to be conducted. <br />f Construction of berm easterly of Bull Seep Canal as a noise reduction facility. <br />
