PROCEDURES AND SUMMARY OF THE REVIEW PROCESS <br />In 1991, Kaiser Ventures filed an application with the Division for a Phase I bond release. The <br />application was approved and the bond was reduced from $800,000 to $320,000, a full 60% <br />Phase 1 bond release. <br />In 1996, Kaiser Ventures filed an application with the Division for a Phase II bond release. The <br />application was approved and the bond was reduced from $320,000, to $120,000, a full 85% <br />Phase II bond release. <br />August 30, 2002, Kaiser Ventures Inc., applied for a partial Phase III bond release under the <br />Colorado Surface Coal Mining Reclamation Act following reclamation of the Chimney Rock <br />Mine. The application for the partial Phase III bond release was deemed complete on September <br />,2002, after the Division received proof of publication of the applicant's public notice. Kaiser <br />Ventures published notice of the bond release application in the Pagosa Springs Sun once <br />weekly for four consecutive weeks, beginning July 16, 2002. Kaiser Ventures also notified land <br />owners within and adjacent to the none permit azea, and other interested parties of the <br />application for bond release, as required by Rule 3.03.2(1). The amount requested for release <br />was $16,800.00. <br />No comments, written objections, or requests for an informal conference regarding the bond <br />release application were received by the Division. <br />The Division scheduled and conducted a bond release inspection on October 17, 2002. The site <br />inspection was conducted in accordance with Rule 3.03.2(2). The principle landowner Melvin <br />Martinez was present during the inspection since he was notified by the Division by letter as to <br />the date and time of the inspection. Also present for the inspection were representatives from <br />Kaiser Ventures, Greystone Consulting, the Office of Surface Mining, and the Division. <br />
