The Durango case has resulted in a lawsuit, but perhaps deserves some <br />scrutiny along with this case. <br />A gravel operation run by Strohecher Excavation was operating in Bayfield with- <br />out a permit and within 50 feet of a property line when neighbors protested <br />last Spring. <br />When a cease and desist order was issued, the operation continued and a permit <br />was subsequently issued although the gravel operation was in violation of <br />several regulations. The permit was allegedly issued without proper notice to <br />the complainants, air-pollution precautions had not been taken, nor was there <br />an on-site inspection of the violations brought to the attention of the Mined <br />Land Reclamation Board. <br />As I mentioned, I believe there is a court case pending so this may be a moot <br />point, but the fact that we have had two similar complaints was a subject of <br />concern. <br />A draft response to Mr. Slovek for Governor Lamm would be appreciated.
