Lunt; <br />Colorado Springs, CO 80907 Division Duecin~ <br />RE: Denial of Your Request for a Dedaratory Order, Shelton Project, File No. M-95-095 <br />Dear Mr. Casey: <br />As you know, the Mined Land Reclamation Board denied your request for a Declaratory Order <br />for your safety project on the Shelton property in Section 10, Township 11 South, Range 60 <br />West, EI Paso County on the grounds that you did not meet all of the exemption conditions of <br />Rule 1.2.3 since the landowner is receiving compensation for the excavated material. <br />The Board also stated that EI Paso County will need to acquire a MLRB permit for the project. <br />Since the project is less than 10 acres a 110 limited impact permit will be appropriate (the <br />application packet I gave you on December 13, 1995). For possible illegal operations the Board <br />allows the operator 60 days to submit a complete 110 application.
