A permit will not <br />he required a[ this time subject to completion of the reclamation plans approved by the Colorado Division of <br />Minerals and Geology. We cannot guarantee that a permit will never he required at any time in the future. <br />The Colorado Water Quality Control Act specifies that CDPS permits are required for all discharges of <br />pollutants to state waters. The discharge from the portal contains pollutants; thus, it is subject [o our <br />regulations. However, it is not our intention to pursue a permit for this facility at this time. <br />It appears that no activity has occurred since 1972 that would impact water quality from the portal discharge. <br />other than your sampling activity in the late 1980's. The recent water analyses furnished to us by you and <br />your representatives indicate that the water quality of the drainage from the poral contains relatively low <br />levels of metals and other pollutants. If reclamation work causes any activities that may degrade the quality <br />of the discharge from the site, we may require a CDPS permit until water quality returns to acceptable levels. <br />We encourage reclamation work that would improve discharge quality, such as planned routing of the portal <br />flow around the waste pile. We request that you keep us apprised of progress with the reclamation activities <br />through completion.
