I have attached a PDF file of the mine site <br />which indicates the areas of mining, and that they have potentially mined outside of and reclaimed areas outside of their <br />final approved reclamation plans (which is not solely visible on the attached PDF file). It appears after reviewing what I <br />think is their mining pernit area -they may not have mined outside their approved limits with the exception of <br />encroaching on the Brantner Ditch at the southeast comer of the pit. They :ue to stay a minimum of 200-feet from the <br />centerline of the ditch and from the information we have been provided, it appears they have encroached within 175-feet <br />of the ditch centerline. Also, the County's concern is that there are areas in Stage 1 and Stage 2 that have or will soon he <br />reclaimed that are much larger than the approved reclamation plan -particularly in Stage 2. Also, there is an issue with <br />the existing power line that transects the Stage 2 mining area. LaFarge has stated to the County they don't think its their <br />responsibility to relocate [he line, when in fact if they don't relocate the line they can't mine underneath it which will <br />result in adouble-celled water storage reservoir -which is not shown on their approved reclamation plan. LaFarge stated <br />to the County they will just request a technical revision from the DMG stating that area of the mine site is too expense to <br />mine and therefore they won't mine it. This is not an adequate excuse for not mining an area because it is impacted by an <br />electric power line which was a known condition at the time of permitting. The County would like to have you discuss <br />this with them (the County) a[ the time of your inspection. <br />Please give me a call if you have any questions about the photo attached to this email. Otherwise, I assume you will be <br />scheduling a site visit. Could you please also let me know when the inspection will occur. Thanks.
