Lung <br />Division Direcw~ <br />This letter is a follow up on a meeting we had earlier today with Tom Leidich of Terra Matrix. <br />Tom asked to meet with us to have a preliminary discussion about permitting a haul road for the <br />"neck" area at the Yoast Mine. Jim Burnell, Harry Ranney and I met with Tom. I just wanted to <br />summarize the points we made to Tom for you. Those points were: <br />During any period of time when a road or portion of a road is located within or directly <br />adjacent to a mine pit, that portion of the road is not a haul road, as far as the regulations <br />are concerned. Probably the best way to summarize the Division's interpretation of <br />what's directly adjacent to a pit is to consider where road runoff will flow. If runoff flows <br />into the pit, that portion of the road may not be a regulated road. If runoff does not flow <br />into the pit, that portion o f the road is a regulated road. <br />2. If alternative specifications for the road need to be used due to steep grades, it will be <br />necessary to demonstrate a minimum static safety factor of 1.3 and road drainage <br />structures will need to be designed to adequately handle storm runoff in accordance with <br />the provisions of Rule 4.03. I . <br />3. Any active, historic or potentially unstable land forms will need to be accounted for in the <br />location and design of the road. <br />4. Any MSHA restrictions on the construction or use of steep haul roads will need to be <br />addressed with that agency. <br />
