Long
Division Director
Re: Coleman Pit, Operated by Saguache County, Permit M-95-07~, Complain[ of Exposed Groundwater.
Dear Mr. Baker,
We have received your second complaint letter concerning the above-named issue. As you recall we investigated
your first complaint about this same matter in June 1999. The operator was found to have a mine plan complivtce
problem and was given a certain date by which the problem was to be corrected. T}te corrective action date was
originally set for 8/10/99.
Before [Ilat date the operator contacted this office with a written request for an extension to the corrective action
date, stating that extra time was needed since resources which normally would have been available for the pit
earthwork was busy elsewhere doing rainy season road repairs. The operator asked for a Rvo-month extension, and
[his request was approved. The new corrective action date has been set for 10/10/99, after which time 1 will inspect
the site for completion of remedial activity there. The problem of exposed groundwater in the pit must still be
corrected by the operator.
Please note that this office makes every effort to treat all operators equally and fairly. If you are dissatisfied with
this response to yoLlr complaint, you may request a hearing before the Mined Land Reclamation Board. [f }~ou have
any questions you may contact me at the Division's Durango field office: 970/247-5193.
Sincerely,
~o~ ~~
Bob Oswald
Environmental Protection Specialist
cc: John Ungefug, Saguache Counh~
a:\coleman ci[2/rco
