Long <br />Division Director <br />Re: Coleman Pit, Operated by Saguache County, Permit M-95-07~, Complain[ of Exposed Groundwater. <br />Dear Mr. Baker, <br />We have received your second complaint letter concerning the above-named issue. As you recall we investigated <br />your first complaint about this same matter in June 1999. The operator was found to have a mine plan complivtce <br />problem and was given a certain date by which the problem was to be corrected. T}te corrective action date was <br />originally set for 8/10/99. <br />Before [Ilat date the operator contacted this office with a written request for an extension to the corrective action <br />date, stating that extra time was needed since resources which normally would have been available for the pit <br />earthwork was busy elsewhere doing rainy season road repairs. The operator asked for a Rvo-month extension, and <br />[his request was approved. The new corrective action date has been set for 10/10/99, after which time 1 will inspect <br />the site for completion of remedial activity there. The problem of exposed groundwater in the pit must still be <br />corrected by the operator. <br />Please note that this office makes every effort to treat all operators equally and fairly. If you are dissatisfied with <br />this response to yoLlr complaint, you may request a hearing before the Mined Land Reclamation Board.
