but not be limited to pumping, clay liner installation, slurry wall installation, backfilling, <br />approval by the Water Court of a plan of augmentation, or approval by the State Engineer of a <br />plan for substitute supply. -Where DMG finds ground water exposed, or the operation not being <br />pumped as specified in an approved MLRB permit, DMG will notify the SEO by sending a copy <br />of the inspection report to a designated person by the SEO. <br />2. Where an operator is approved to conduct a dry mining operation that does not expose <br />ground water, and the approved application includes ground water elevation monitoring wells, <br />DMG will ensure that the operator supplies the ground water elevation data to DMG as specified <br />in the approved application. DMG will make such information available to the SEO when <br />requested within a reasonable period of time. <br />Enforcement• <br />The parties agree to coordinate and pursue enforcement actions in the following manner: <br />1. SEO is responsible for any enforcement action designed to reduce or eliminate injury <br />to water rights. <br />2. DMG is responsible for any enforcement action designed to ensure compliance with an <br />MLRB reclamation permit. <br />3. Where there is a potential for overlap, the parties will jointly determine the appropriate <br />enforcement process as soon as possible. <br />4. However, it is understood that SEO will generally pursue compliance with SEO <br />requirements through implementation of its own instruments. <br />Release of Financial Warranties: <br />The parties agree to coordinate the release of the financial warranty in the following manner: <br />1. DMG will follow the warranty release process as specified in the DMG Rules and <br />regulations. DMG will inspect the site prior to granting or denying the operator's request for <br />financial warranty release. Where DMG finds issues that DMG believes maybe of interest to the <br />SEO, DMG will copy SEO with the release inspecfion report and proposed decision to a <br />designated person by the SEO. Areas of SEO concern, at a minimum, include seeps, springs, <br />water wells, monitoring wells, and exposed ground water. <br />2. If the SEO objects to a site being released, SEO will provide the objection in writing <br />to DMG within 10 days of DMG's inspection of the affected azea, or provide an appeal to the <br />release decision within 15 calendar days of the decision by DMG to release the affected area. <br />A:Unoua~seomou.wp <br />4 <br />
