MEMCiRANDUM30F UNDERSTANDING <br />BETWEEN THE <br />DIV. OF MINERALS & GEOLOGY, MINERALS PROGRAM <br />AND THE <br />DN, OF'WATER RESOURCES, OFFICE OF THE STATE ENGINEER <br />PURPOSE <br />The purpose of this Memorandum of Understanding (MOU) is to define the respective <br />responsibilities of the Division of Minerals and Geology, and the Division of Water Resources, <br />Office of the State Engineer regazding mineral mining activities as they relate to water rights <br />issues. In addition, it is the intent of this MOU to: <br />1. Ensure the coordination of agency actions in such matters. <br />2. Ensure that appropriate agency actions aze taken at mining operations to protect <br />the water resources of the state. <br />3. Foster enhanced communications and working relationships between the two <br />Divisions. <br />4. Coordinate enforcement acfions so as to minimize dual enforcement to the extent <br />possible, while maintaining the integrity of the programs implemented by each Division. <br />UNDERSTANDING BETR'EEN THE DIVISIONS <br />This MOU is entered into by the Division of Minerals and Geology (DMG), and the Division of <br />Water Resources, Office of the State Engineer (SEO), (the parties) and may be modified by <br />written concurrence of both parties. <br />Nothing in this MOU will be construed to preempt or alter the statutory or regulatory <br />responsibilities and authorities of either party. This MOUreplaces all previous MOU's between <br />the SEO and the DMG including, but not limited to, the MOU dated Apri128, 2002. <br />This is entered this Day of, ~9 ; ~'~ ~ C7 y ~~ <br />Ronald W.
