The drilling of the large dialneter vertical shaft on our property neaz the <br />long wall resulted in our water well close to the works going dry. Our <br />concerns about the impact of this large airshaft were pointed out in writing <br />long before [he shaft was installed and we have always been told that the <br />airshaft was completely cased all the way to the bottom. If this had <br />been done, the water bearing fonnation in which we have wells should not <br />have been damaged. The well closest to the airshaft is ruined and the one r, <br />closer to the river is severely handicapped. <br />2. We just tried Tattun vs. Basin in cause number O1CV26 in the District <br />Court of Las Animas County Colorado. The Court ruled that Basin's <br />operations damaged our home by subsidence and damages of <br />approximately $670,000.00 and all costs and attorneys fees were awarded <br />to us. Pre judgment and post judgment interest was also awarded to us <br />resulting in a final award of $900,000 - 1,000,000. <br />3. We learned that the representation that the airshaft was cased was <br />absolutely false and perjury was committed in the first Tatum-Basin trial. <br />4. .fim and Ann Tatum own 100 percent of the mineral under our tract of <br />land. Capping off the airshaft with concrete is not sufficient. This hole <br />should have been backfilled and the water zones cemented off. X <br />
