VII. Alluvial Valley Floors - Rules 2.06.8 and 4.24 <br />A reconnaissance alluvial valley floor investigation for the permit and <br />adjacent areas was conducted. The study did not find areas which would be <br />classified as alluvial valley floors based on the criteria in Rule 2.06.8 The <br />reconnaissance study conducted by Panorama Resources Services incorporated as <br />part of the SOAP study evaluated the stream valley of Starksville Gulch, <br />Engleville Gulch and along the Raton Creek. The study consisted of a review <br />of available air photos and by walking the subject drainages. The analysis of <br />the air photos revealed one plot of agricultural land in the NW/SE Section 20, <br />Township 33 South, Range 63 West. Although it is agricultural land it does <br />not meet the criteria of an AVF. There were no areas found with <br />unconsolidated stream laid deposits holding streams in the area. <br />Therefore the Division has made a negative determination for the existence of <br />alluvial valley floors within the permit area and aajacent areas. <br />The proposed operation is in compliance with the requirements of the section. <br />VIII. Water Rights and Replacement -Rules 2.04.7{3), 2.05.6(3)(a)(ii <br />The applicant has provided information on water rights in the vicinity of the <br />mine site on pages 2.05.63 (Pages 1-3) of the application. Appropriate <br />materials were provided to the office of the State Engineer, Colorado Division <br />of Water Resources, for an opinion on potential damage to existing water <br />rights. The State Engineer's office has no objections to the proposed <br />decision. All water to be utilized will be hauled in from offsite sources. <br />There are no surface water users or persons with water rights whose supply <br />would be impacted by the mining. <br />The proposed operation is in compliance with the requirements of this section. <br />- 11 - <br />
