(MCR) and <br />by Pitkin Iron Corporation, (PITKIN IRON) P. O. Drawer 790, <br />Glenwood Springs, CO 81601, the Appeal being from Letter Decision <br />dated February 25, 1994 of U. S. Bureau of Land Management, <br />Glenwood Springs, CO, copy attached as Exhibit B to which was <br />attached Exhibit D. <br />Notice of Appeal was served by Certified Mail as appears from <br />Receipts attached hereto as Exhibit C. <br />1.0 Statement of Facts. <br />Under date of April 12, 1982 Mid-Continent Resources, Inc. <br />(MCR) leased the Tiger Placer Claims 2-6 inclusive, Lynx Placer <br />Claims 2-6 inclusive, and Lion Placer Claims 2-6 inclusive <br />containing 260 acres more or less from CFI Steel Corporation <br />(CF&I). These claims had theretofore been located by CFI as <br />Placer Mining Claims based on high calcite limestone deposits. <br />MCR thereafter sub-leased to Pitkin Iron Corporation and <br />Pitkin in 1983 obtained the necessary permits from Garfield County, <br />Mined Land Reclamation Division of Colorado (MLRD), with <br />concurrence of BLM and opened a limestone quarry called the "Mid- <br />Continent Limestone Quarry". The quarry was operated by Pitkin <br />from 1983 until 1992. Primary uses of the limestone included sale <br />to a power plant at Craig, Colorado; production of rock dust for <br />use in dust control in coal mines in Western Colorado, produced by <br />pulverizing the limestone in a plant belonging to MCR at <br />Carbondale, Colorado; cattle feeding, and similar uses. These uses <br />required screening out of fines and material containing dirt, wood <br />or other debris which was placed in stockpile at the quarry and <br />used for road surfacing, parking lots and similar uses. <br />in October, 1993 the BLM gave notice of cancellation of the <br />claims because of failure to pay the 5100 rental fee on each claim <br />as required by the Act of Congress passed in 1992. <br />
