Lamm <br />Governor <br />DATE <br />To: <br />FROM <br />RE: <br />May 11, 1984 <br />Jim McArdle <br />Jim Pendleton - I~,~,..-~~ <br />Colony Proj - Re ding of "Excess Fill" and Mine Bench, and <br />Channel Im in the Lower Davis Gulch <br />Pursuant to your request, I have completed a review of Exxon U.S.A.'s proposal <br />letter, dated April 25, 1984. Briefly, Exxon proposes to accomplish three <br />tasks; <br />(1) Regrading of the Lower Davis Gulch "Excess Fill", removing <br />approximately 900,000 cu. yds. of earthern material; <br />(2) Backfilling of the crusher excavation and regrading of the mine <br />bench surface, using the 900,000 cu. yds. excavated from the "Excess <br />Fill"; and, <br />(3) Improvement of a portion of the diverted Middle Fork drainage <br />channel located in Lower Davis Gulch, below the "Excess Fill". <br />In my opinion, the proposed modification are desirable and approvable. <br />Submittal of these modifications satisfies the concerns expressed in <br />Stipulation No. 6 of my December 21, 1982 memorandum to you. Those <br />stipulations, as amended, were adopted by the MLRD Board on <br />December 16, 1982. Completion of these three specific tasks will satisfy my <br />final seventh stipulation, which requires completion prior to the end of <br />1984. The operator projects completion by that deadline. <br />I add the following comment. While the operator observed that the flume <br />currently carrying the Middle Fork of Parachute Creek down the face of the <br />mine bench is preforming acceptably, following minor repairs, I doubt that <br />this diversion will be acceptable on a permanent basis. If permanent <br />cessation were to occur at the Colony Project, this channel would require a <br />permanent, low-maintenance solution. <br />It is my intention to visit the Colony Site later this summer, preferably near <br />the completion of these three modifications. <br />cc: Dave Shelton <br />/ph <br />Doc.
