ATTACHMENT C <br />AFFIDAVIT <br />STATE OF COLORADO ) <br />RIO BLANCO COUNTY ) <br />ss. <br />AFFIDAVIT <br />GLENN L. PAYNE, being duly sworn,under oath, deposes and <br />says: <br />1. I am the Director of Planning for Rio Blanco County. <br />In this position I have primary responsibility for the County's <br />review of State and Federal Mining plans or applications, and <br />determining the extent to which they are consistent with County <br />policies, programs, and regulations. <br />2. My initial review of the Western Fuel-Utah mining <br />plan is that it must include significant Socio-Impact Mitigation <br />measures before it can comply with Rio Blanco County's Master Plan. <br />The mitigation measures proposed thus far by Western Fuels and <br />"Deseret" which are contained in the final Environmental Impact <br />Statement do not address the basic issues of how the County and <br />its affected municipalities will provide essential community services <br />and housing to meet growth attributable to the mining operations. <br />Failure to include such essential provisions in the mining plan <br />puts Western Fuels at odds with Sections 10, 11, 12, 14, 19, 20, <br />22, and 23 of the County Master Plan. <br />3. Accordingly, the proposed mining operation should <br />be designated as "unsuitable for mining"under section (b) (i) of <br />the C.R.S. 34-33-126 until sufficient mitigation measures are <br />incorporated into the plan so that it is consistent with the '3 <br />County Master Plan.
