Box 229 Boulder, Colorado 80302 Dear Margie: I have spoken with Elvin Clapp of the Kremmling BLM office regarding the Ranch Road at Mann Draw, Mr. Clapp maintained that BLM had no preference in this matter, and that what Flatiron had been told was that BLM had, "no problem with the road the way it was". BLM rteintains that as long as the affected area is within the BLM right-of-way, the change requested is a minor one (which it is in this case), and Flatiron will maintain the amended surface in compliance with BLM's right-of-way conditions, Flatiron need not send BLM a request to amend the right-of-way agreement. In view of this information, Flatiron (WaZ den Coal Company) is directed to regrade the BLM Ranch Road in the immediate area of Mann Draw as discussed on October 28, 1980, and in the written inspection report for that date. The completion of this work should be accomplished before January 2, 1981. This work does not exempt the operator from any obligation to the BLM right-of-way agreement. MLR will forward to BLM the exact nature, and extent of the changes to be made. FZatiron (Walden Coal Company) is also notified that this office has not received any request for a revision to their permit which eliminates culvert A at the county road. Amine plan revision on this topic was due in this office November 30, 1980. BLM has responded to queries made by Flatiron. If a request is not received by this office by January 2, 1981, Flatiron (Walden Coal Co.) will be considered to be operating in violation of their approved mining plan.
