Box 229 <br />Boulder, Colorado 80302 <br />Dear Margie: <br />I have spoken with Elvin Clapp of the Kremmling BLM office regarding the <br />Ranch Road at Mann Draw, Mr. Clapp maintained that BLM had no preference <br />in this matter, and that what Flatiron had been told was that BLM had, "no <br />problem with the road the way it was". BLM rteintains that as long as the <br />affected area is within the BLM right-of-way, the change requested is a <br />minor one (which it is in this case), and Flatiron will maintain the amended <br />surface in compliance with BLM's right-of-way conditions, Flatiron need not <br />send BLM a request to amend the right-of-way agreement. <br />In view of this information, Flatiron (WaZ den Coal Company) is directed <br />to regrade the BLM Ranch Road in the immediate area of Mann Draw as <br />discussed on October 28, 1980, and in the written inspection report for that <br />date. The completion of this work should be accomplished before January <br />2, 1981. This work does not exempt the operator from any obligation to the <br />BLM right-of-way agreement. MLR will forward to BLM the exact nature, and <br />extent of the changes to be made. <br />FZatiron (Walden Coal Company) is also notified that this office has not <br />received any request for a revision to their permit which eliminates culvert <br />A at the county road. Amine plan revision on this topic was due in this <br />office November 30, 1980. BLM has responded to queries made by Flatiron. <br />If a request is not received by this office by January 2, 1981, Flatiron <br />(Walden Coal Co.) will be considered to be operating in violation of their <br />approved mining plan. <br />Feel free to call if you have any questions. <br />Sincerely, <br />Michael S.
