This document contains the findings and decision pertaining to a Request for Transfer of Coal <br /> Permit and Succession of Operators (Succession). The Succession application was received by the <br /> Division of Minerals and Geology (DMG) on March 20, 1995. The Succession application proposes <br /> a transfer of DMG Permit No. C-81-045 from the current permittee and operator, which is The <br /> Corley Company, to a new permittee and operator, which is Energy Fuels Coal, Inc. (EFCI). The <br /> mine name will remain the Newlin Creek Mine. The Succession application was submitted and <br /> reviewed pursuant to the procedures of Rule 2.08.6 of the Regulations of the Colorado Mined Land <br /> Reclamation Board for Coal Mining. The DMG hereby conditionally approves the Succession <br /> request. <br /> Process <br /> On March 20, 1995, the above-referenced succession application was received at the offices of the <br /> DMG. The initial Succession application was a properly executed Request for Transfer of Coal <br /> Permit and Succession of Operators form, as required by Rule 2.08.6(2)(b). The DMG sent an <br /> initial adequacy letter to The Corley Company and EFCI's representatives on April 5, 1995. On <br /> May 30, 1995, certain financial warranty materials were received by the DMG, and additional <br /> application materials were received by the DMG on June 6, 1995. The newspaper notice required <br /> by Rule 2.08.6(3) was published in the Canon City Daily Record on March 30, 1995, and the <br /> Affidavit of Publication was received by DMG on June 8, 1995. An additional adequacy letter was <br /> sent on June 9, 1995. A "Legal Right to Enter" document was received on June 29, 1995. Proper <br /> evidence of liability insurance was received by the DMG on July 27, 1995, and additional applica- <br /> tion materials were received on July 28, 1995. The last required financial warranty materials were <br /> received on August 21, 1995. The decision to approve the succession application was issued on <br /> August 21, 1995. <br /> Findings <br /> 1. The DMG hereby finds that a properly executed Request for Transfer of Coal Permit and <br /> Succession of Operators application form has been submitted to the DMG, and this form <br /> requests that the DMG Permit No. C-81-045 be transferred from The Corley Company to <br /> Energy Fuels Coal, Inc. (2.08.6(2)(b)). <br /> 2. The DMG hereby finds that a properly executed Surface Coal Mining and Reclamation <br /> Operations Reclamation Bond, in the form of two Certificates of Deposit (CD), have been <br /> received and reviewed. These are CD No. 505716420 in the amount of $21,000.00 <br /> (twenty-one thousand dollars) and CD No. 505395009 in the amount of$4,662.00 <br /> (four thousand six hundred and sixty-two dollars). These were originally posted by The Corley <br /> Company, and they are transferred with this Succession pursuant to 2.08.6(2)(a)(i). The Corley <br /> Company submitted a notarized letter dated May 12, 1995, specifically conveying these instru- <br /> ments to Energy Fuels Coal, Inc. for the purpose of providing financial warranty for the <br /> Newlin Creek Mine. The required financial warranty forms have also been properly executed <br /> by Energy Fuels Coal, Inc. (2.08.6(2)(a) and 2.08.6(4)(b)). <br />
